GM Class Action Lawsuit Filed Due To Alleged Recalled Faulty Ignition Switch

(MoneyNewsWire.Net, May 25, 2014 ) Detroit, MI -- The Oliver Law Group has filed a defective ignition switch class action lawsuit against General Motors on behalf of a Livingston County, Michigan woman whose 2004 Saturn Ion allegedly shut down on her while she was driving the vehicle, forcing her to leave the roadway. GM has been the focus of multiple recalls due to faulty ignition switches which have allegedly been the cause of hundreds of accidents including 13 deaths and GM has faced scrutiny for purportedly knowing about the faulty ignition switches and not reporting the issue for over decade. This class action lawsuit against General Motors LLC, which manufactures Saturn vehicles and Delphi Automotive PLC, which manufactures ignition switches, was filed in the U.S. District Court, Eastern District of Michigan (Case No. 2:14-cv-11912).

According to the GM Class Action Lawsuit the Michigan woman was unaware of any ignition switch defects in the 2004 Saturn Ion when she purchased the vehicle in 2013, and further purports she experienced stalling after she purchased the Saturn Ion. In one incident, the engine and electrical system shut down without warning while the vehicle was in the middle of the road. The woman was able to coast the Saturn Ion to the side of the road without injury, and was later able to safely restart the car. The complaint further contends that the woman is now left with a defective vehicle with a greatly diminished resale value. The class action lawsuit alleges that “Old GM” (referring to General Motors prior to its bankruptcy filing in 2009) and GM (the company incorporated after its emergence from bankruptcy in 2009) knew about the defective ignition switches for years but failed to disclosed the problems to the public. The complaint further alleges that the ignition switch defect causes the cars’ engines and electrical systems to shut off, which disables the power steering and power brakes and results in the airbags failing to deploy (Case No. 2:14-cv-11912).



According to the Wall Street Journal, GM has recalled 2.6 million vehicles due to faulty ignition switches in two separate notices since February 2014 involving the Saturn Ion, Chevrolet Cobalt, and Pontiac G5. What makes this recall more disturbing are the reports by the Associated Press that GM knew about the faulty ignition switches since 2001. In March of 2014, The Wall Street Journal also reported GM documents from 2003 indicated a service technician observed an Ion stall while driving, and an engineering inquiry was opened but later closed after determining it would take too long and cost too much to fix. Unfortunately, it wasn’t until 2013 that GM began notifying dealers of the faulty ignitions switches after a 16-year-old Maryland resident died after crashing into a tree when the ignition switch turned off the electrical system in her 2005 Chevy Cobalt and the vehicle’s air bags failed to deploy. This was the first fatality involving the ignition switch, but unfortunately not the last. As the AP reports a total of 13 fatalities and 43 crashes have purportedly been linked to the faulty GM ignition switches. GM began initiating the 2.6 million car recall after multiple meeting in January of 2014.

In addition, USA Today reported that GM CEO Mary Barra stated, the recalls will cost the company about $300 million, which is less than $100 per recalled vehicle. Due to the response of GM during the recall, the company is currently under criminal investigation by the U.S. Attorney in New York and CEO Mary Barra appeared before a Congressional panel to answer questions regarding GM’s handling of the faulty ignition cases in April of this year and has since been fined $35 million by the federal government for their delay in recalling the defective ignition switch and the safety issue it proposed.

According to court documents, due to mounting class action lawsuits throughout the country against GM, a motion has been filed with the U.S. Judicial Panel of Multidistrict Litigation (JPML) asking that all GM defective ignition switch lawsuits be transferred to the U.S. District Court, Southern District of California (In Re: General Motors LLC Ignition Switch Litigation – MDL 2543) for coordinated pretrial proceedings. The JPML has scheduled a hearing on the motion for May 29th in Chicago.
