GM Ignition Switch Recall Lawsuit Filed on Behalf of Michigan Woman Seriously Injured in Collision Allegedly Caused by GMÂ’s Faulty Ignition Switch

(MoneyNewsWire.Net, May 22, 2014 ) Detroit, MI -- The Oliver Law Group P.C. announces that they have filed a GM Ignition Switch Recall Lawsuit that seeks compensation for serious personal injuries allegedly sustained by a Wayne County, Michigan woman as a result of a 2012 automobile collision that was allegedly caused by a faulty ignition switch. The GM faulty ignition switch lawsuit claims that the Plaintiff’s 2006 Saturn Ion was among more than 2.6 million General Motors (GM) vehicles fitted with an ignition switch that can unexpectedly and suddenly move from the “On” or “Run” position to the “Off” or “Acc” position. When this occurs, the motor engine and certain electrical components, including the power assisted steering and anti-lock brakes are turned off, thereby endangering the vehicle occupants and compromising the safety airbag system. The lawsuit, which was filed in Wayne County Circuit Court on May 19, 2014, names General Motors LLC and Delphi Automotive PLC among the defendants. (Case No. 14-006509-NP)



In February 2014, GM issued a recall for more than 2.6 million small cars, including the plaintiff’s 2006 Saturn Ion, after it acknowledged the issue with the ignition switch. According to report from The Washington Post, a subsequent congressional investigation found that GM had made a design change to the ignition switch in 2006 that solved the problem. But the issue was kept hidden because GM never issued a new part number for the modified ignition switch, and no recall was announced at that time to repair defective switches in cars that had already been sold.

According to the Washington Post, federal regulators have now tied at least 13 deaths to crashes that were caused by the defective ignition switch. On May 16, 2014, GM agreed to pay a $35 million penalty for its failure to address the ignition switch flaw prior to February 2014. The fine is the maximum penalty that the National Highway Traffic Safety Administration can impose on an automaker for failing to disclose a safety issue in a timely manner. Federal prosecutors are also looking into the possibility of filing criminal charges against the company, the Washington Post said.



According to her lawsuit, the Plaintiff being represented by The Oliver Law Group sustained a number of serious injuries, including a concussion, closed head injury, and costochondritis, as a result of an automobile collision that occurred in August 2012. The complaint alleges that at the time of the crash, the Saturn Ion’s air bags did not deploy as a result of her automobile’s defective ignition switch. The Plaintiff further alleges that the severity of her injuries would have been mitigated had the air bags deployed properly. Among other things, the lawsuit charges GM and other defendants with gross negligence for failing to exercise ordinary care in designing, manufacturing, marketing, testing, selling and distributing the Plaintiff’s vehicle.
